Terms of Service

These Terms of Service (“Terms”) govern your access to and use of curblist’s website and application (the “Service”), operated by curblist (“we,” “us,” “our”). By creating an account or using the Service, you agree to these Terms. If you’re accepting on behalf of a brokerage or team, you’re confirming you have authority to bind that organization.

1. Who can use curblist

curblist is built for licensed real estate professionals and the teams that support them. You must be at least 18 years old and able to form a binding contract to use the Service. You’re responsible for the accuracy of any license information you add to your brand kit and for using it in compliance with your local licensing rules.

2. What curblist is — and isn’t

curblist is marketing software: it generates listing copy, social graphics, flyers, and hosted property pages from details an agent enters. curblist is not a licensed real estate broker or brokerage in Florida or any other state, is not an MLS, does not provide listing syndication, transaction management, escrow, or any other brokerage service, and is not a party to any real estate transaction conducted by a user of the Service. We do not represent buyers, sellers, landlords, or tenants, and we do not negotiate, procure, or vet prospects on anyone’s behalf.

curblist’s founder(s) may individually hold a real estate license, but curblist is a software company, not a brokerage — providing the Service to licensees is a technology service, not the practice of real estate, and does not extend any individual’s personal license to the company or to any user of the Service. Every user remains solely responsible for holding whatever license their own jurisdiction requires for the real estate activity they conduct, and for using the Service in compliance with their brokerage’s policies and their state’s real estate commission rules (in Florida, the Department of Business and Professional Regulation).

3. Your account

You’re responsible for keeping your password confidential and for all activity under your account. Tell us right away at success@curblistit.comif you suspect unauthorized access. One account may belong to one organization (“workspace”) at a time unless you’re invited to additional teams.

4. Plans, trials, and billing

• New workspaces start on a 14-day free trial of the plan you selected at signup — no card required.
• Paid plans are billed monthly or annually in advance through Stripe, our payment processor; annual plans are billed once for the full year.
• Plans renew automatically until you cancel. You can cancel or change plans at any time from Settings — access continues through the end of the current billing period.
• Fees are non-refundable except where required by law or stated otherwise at the time of purchase.
• We may change plan pricing going forward; we’ll give you notice before a price change affects your active subscription.

5. Content you provide

You keep ownership of the property details, photos, and brand assets (logo, headshot, etc.) you upload (“Your Content”). By uploading it, you grant curblist a license to store, process, and display Your Content solely to provide the Service to you — generating copy, rendering graphics, and similar features. You’re responsible for having the rights to everything you upload, including photo usage rights and MLS compliance for any listing data you enter.

6. AI-generated content

curblist uses Google’s Gemini API to generate listing copy from the details you provide (see our Privacy Policyfor what’s sent). AI output can be inaccurate, generic, or occasionally wrong — you’re responsible for reviewing and editing every generated description, caption, or email before you publish or send it. curblist does not guarantee the accuracy, originality, or fitness of any AI-generated content for a particular purpose.

7. Fair Housing compliance scan

The compliance scan is a tool to help flag common Fair Housing issues in generated copy — it is notlegal advice and does not guarantee compliance with the Fair Housing Act, state fair housing laws, or your brokerage’s own policies. You remain solely responsible for reviewing and ensuring every asset you publish complies with applicable law. See our Fair Housing commitment for more.

8. Acceptable use

You agree not to:

• Use the Service to publish content that violates Fair Housing law or any other applicable law;
• Upload photos or content you don’t have the rights to use;
• Attempt to reverse-engineer, scrape, or resell the Service without our written consent;
• Share your login credentials outside your workspace, or use the Service to compete with curblist;
• Interfere with the Service’s operation or attempt to access another workspace’s data.

9. Our intellectual property

curblist, our logo, the template designs, and the underlying software are our property (or our licensors’). These Terms don’t grant you any rights to our trademarks or brand assets beyond using the finished marketing assets the Service generates for your own listings.

10. Termination

You can close your account at any time from Settings. We may suspend or terminate your access if you materially breach these Terms — including publishing content that violates Section 8 — after giving you notice and a reasonable chance to fix the issue where the breach isn’t severe or repeated.

11. Disclaimers

The Service is provided “as is.” We don’t warrant that it will be uninterrupted, error-free, or that AI-generated or compliance-scanned content will be complete or accurate. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the extent permitted by law, curblist won’t be liable for indirect, incidental, or consequential damages arising from your use of the Service, including any Fair Housing or legal exposure resulting from content you publish, or from your own real estate licensing status or conduct as an agent, broker, or brokerage. Our total liability for any claim is limited to the greater of the amount you paid us in the 6 months before the claim arose, or $100.

13. Changes to these Terms

We’ll update the date at the top of this page when we make changes, and for material changes, we’ll notify you by email or an in-app notice before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
